TECHNOVAX S.A. (a joint venture
of two major Greek construction companies, AVAX and HELLENIC
TECHNODOMIKI) embarked on a project for the construction and
exploitation of an oil terminal on the Moldovan bank of the
Danube river ("Giurgiulesti Oil Terminal"). The services
provided by a current associates of TSIRONIS & ASSOCIATES
included the negotiation of the Loan Agreement and the relevant
project agreements with the European Bank for Reconstruction
and Development, as well as overall legal support during the
construction phase (vis-a-vis subcontractors and suppliers,
the Moldovan Government and the EBRD). The construction of the
terminal was advanced when the Moldovan side failed to perform
its obligations and the related dispute was led to pending arbitration. |

This
technical assistance project concerned the co-ordination and
supervision of the rehabilitation works (financed by the EU
TACIS Programme) of the container terminals of the ports of
Baku and Turkmenbashi, which are both vital links of the TRACECA
route. The supervision and co-ordination services were provided
by a multi-disciplinary team including legal, technical and
marine transportation experts (including highly qualified local
experts) which was involved in all the stages of the rehabilitation,
from the selection of the tenderer to the implementation and
completion of the works. During the progress of the works, many
problems were encountered and successfully overcome, including
the interface between the contractor and local authorities and
beneficiaries, the amendment of technical specifications and
designs, the management of financial issues, the certification
of works performed, etc. |

SARANTOPOULOS S.A. (currently PANTECHNIKI SA), a major Greek construction
company, was awarded an EU-funded PHARE project for the rehabilitation of the
Durres-Rrogozhine road in Albania on the contractual basis of the FIDIC Red Book.
The project encountered several major problems, including widespread violence
interrupting the works, serious delays in the expropriation of the land necessary for
the construction of the road, legislative and administrative bottlenecks, and various
issues regarding unit prices and measurements, requiring extensive legal advice and
representation before Albanian and EU authorities. Total claims of EUR 14.750.000
are currently pending before an International Chamber of Commerce arbitral tribunal. |
- Legal (TSIRONIS & ASSOCIATES) and technical (PROMAS SA) advice
regarding the interpretation and implementation of the FIDIC Red Book-based contract
- Representation and support in negotiations with the Engineer, the European
Commission and the Albanian Government

the relevant Georgian legislation, the drafting of a concession
